(3) Where the Chairman has been disqualified under subsection (2), the Minister shall appoint another member of the Tribunal to act as Chairman for the purposes of that proceedings. (4) A person is deemed to have a pecuniary interest if he, his partner, employer or any member of his family or if a body whether statutory or not of which he is a member has a pecuniary interest in any matter which is to be determined by the Tribunal.
(1) Any person may apply to the Tribunal for a license to produce and publish in the national language a translation of a literary work written in any other language. (2) The Tribunal after holdings such inquiry as it thinks necessary may, subject to this section, grant to the applicant a license (not being an exclusive license) to produce and publish a translation of the work in the national language, on condition that the applicant shall pay to the owner of the right of translation in the work in respect of copies sold to the public, royalties at a rate to be determined by the Tribunal in the prescribed manner. (3) A license may be granted on an application made under subsection (1) in respect of a work only where ----
(a) a translation of the work in the national language
has not been
(b) (i) the applicant has requested
and been denied authorization by
(ii) the applicant, after due diligence on his part, is unable
to find the
(c) the applicant, if the nationality of the
owner of the right of translation is |
